Electronic Signature Disclosure & Consent

1. Consent to sign electronically

By clicking to sign a document through Pactly, you agree to conduct this transaction electronically and you agree that your electronic signature has the same legal effect as a handwritten signature on paper. This is what the U.S. ESIGN Act and UETA, the EU eIDAS Regulation, and comparable laws in other jurisdictions provide for.

You are not required to sign electronically. If you would rather sign on paper, contact the person who sent you the document and ask them to send it another way.

2. What you're agreeing to

Your electronic signature is applied to the document shown to you in the signing window. Before you sign, you can scroll the entire document, zoom in, and review every field you are being asked to complete. Sign only after you have read and understood the document.

Where the sender has enabled it, we may show you an AI-generated plain-language summary. That summary is a reading aid, not legal advice, and it is not part of the agreement. The document text always governs.

3. What we record when you sign

To evidence your signature, we record and attach to the signed document:

• your name and email address as entered by the sender;
• the date and time you signed, in UTC;
• your IP address and browser user-agent;
• an approximate location (city, region, country) derived from your IP address;
• a device fingerprint derived from the above and your unique signing link;
• SHA-256 hashes of the document before and after signing.

This information appears on the Certificate of Completion attached to the signed PDF, which is provided to the sender and to every other party to the document. Signing means you accept that disclosure.

4. Hardware and software you need

• A current version of a major web browser (Chrome, Edge, Firefox or Safari) with JavaScript enabled.
• An internet connection.
• A valid email address that can receive our messages.
• A way to view and save PDF files.
• A device that lets you draw, type, or upload a signature image.

If our requirements change in a way that could stop you accessing your records, we'll tell you and give you the chance to withdraw consent without penalty.

5. Getting a copy of your document

As soon as you sign, you can download your signed copy from the confirmation screen. When every party has signed, the fully executed document is available to the sender, who can forward it to you. Save your copy - for documents signed through the no-account flow on our home page, the file is deleted automatically a short time after signing and cannot be recovered.

To request a paper copy, contact the sender of the document. We do not charge for electronic copies.

6. Withdrawing your consent

You can withdraw your consent to sign electronically at any time before you sign - either by using the decline option in the signing window, or by contacting the sender directly. There is no penalty for withdrawing.

Withdrawing consent does not undo a signature you have already applied. Once you have signed, the document is executed and the audit record is fixed. To change or cancel a document you have already signed, you need to reach agreement with the other parties to it.

7. Documents that cannot be signed electronically

Some documents must be executed on paper, before a notary, or through a specific regulated process. Wills and codicils, certain family-law instruments, some property transfers, and some court filings are common examples, and the rules differ by jurisdiction. Pactly does not check this for you. If you are unsure whether electronic signature is valid for your document, get legal advice before signing.

8. Updating your contact details

If your email address changes, tell the sender so they can reissue your signing link. Signing links are unique to one recipient and cannot be forwarded to a different address.
